DEAR TENANTS: CEDAR RAIL RESORT LTD. HAS ADOPTED A SET OF BYLAWS THAT WE AS OWNERS AND TENANTS MUST OBSERVE FOR THE SAFETY AND ENJOYMENT OF EVERYONE, ESPECIALLY THE OWNERS WHO LIVE HERE FULL TIME ON THE PROPERTY. THESE GUIDELINES ARE ALSO FOR THE PRESERVATION OF THE MUSKOKAS' ENVIRONMENT AND SETTING. THEY ARE SET OUT HEREUNDER.
If not acceptable, perhaps Cedar Rail is not the place for you and yours.
* Prior to entering an agreement to rent, have all users, children and adults, clearly read and/or understand the Rules/Guidelines listed here and sent to approved tenants and signed off by them.
* No more than 8 adults/children in the cottage or on the Cedar Rail site at any one time; ie, 12 over for a BBQ or at the beach is a "no-no". This includes overnight or day guests. This is the Cedar Rail and Muskoka Lakes Association guideline for the Septic system capacities. It is also the Cedar Rail guideline for renters as set down by the owners.
Note: Each guest of a tenant on the property over and above the occupancy limit must pay a $50.00 per day surcharge to the Corporation (not the individual owner) to compensate on the extra load on the systems and overcrowding on the beach. If this is not in place and there is a violation(s), the renter would be intentionally ignoring the signed agreement and be asked to leave without refund. Let us preserve our beautiful Muskokas and the community members of Cedar Rail. That is why we prefer no more than 8 people from one family. Please call the owner for clarification.
* Use of the cottage, its contents or the Cedar Rail property is at the renters own risk and the owners shall not be held accountable or liable for personal injury/death with such use of same.
* The damage/deposit fee will be returned based on the condition of the cottage, its contents and the property as well as the level of cleanliness once the renters leave. If major clean up is required, a fee may be determined based on an hourly rate of $50.00 beyond our normal clean up time.
* Use of illegal substances such as alcohol for those under age; drugs, including mirijuana is prohibited and will result in immediate ejection without refund. This ejection also applies to illegal activities such as unlawful assembly and possession of legal or illegal arms.
* This is a non-smoking unit. No smoking is permitted in the chalet. If smoking outside, please do not litter the site with cigarette, cigar butts or pipe tobacco. Use proper disposal methods. Be AWARE of the dry spells and the FIRE HAZZARDS of our indoors and outdoors. Do NOT smoke around boat engines or near any fuel oil/natural gas/propane areas.
* Tenants, their families and day guests shall not use tents, house trailers or travel homes on the property. Day guests are asked not to stay overnight.
* Tenants and their guests are not permitted to have pets on the property. Some owners do have pets (all friendly) that are familiar with the surroundings and each other. All pets are to be leashed and monitored closely. Two of the Birch's owners are allergic to animals, etc and guests may also be excluded if pets were to be permitted; hence the decision in reference to the Birch alone.
* Tenants shall keep no more than one boat or Power Water Craft (PWC) in the assigned outdoor dock berth, specifically the unit owner's slip. No more than one boat on the designated Birch slip; no tie on's to that single craft. No other slips may be used. They are other owner slips. No off shore anchored boats either. This includes water trampolines or rafts. Our space beyond the docks are limited. Canoes are allowed on shore away from the docks and beach on land by the other canoe(s). No boats shall be tied off on the inside dock facing the swimming (beach) area as per dock use. These are rulings set down by the Muskoka Lakes Association and/or the Cedar Rail Community.
* Do not use the boat house; it is privately owned by Paul Heenan, owner of the unit beside us.
* Tenants of the Birch can only park in the 3-4 spaces provided for at the Birch. Four (4) vehicles would be a snug fit. Only that parking area can be used. The neighboring unit's space (Paul Heenan's) is not for parking use nor is the main driveway. No driving or parking on the grass by any motorized vehicle. Such vehicles leave ruts in the grassy area resulting in potential hazzards to those who wish to play in those areas.
* Tenants shall not use any electronic equipment such as radios in such a manner as to interfere unreasonably with the use and enjoyment of the property by others.
* The time between 11 pm and 8 am is designated "Quiet Time". tenants shall ensure that they, their families and non-paying day guests respect quiet time and keep noise down to a minimum during that time.
* Boat trailers can be stored ONLY in the designated area. ( Field located behind Units 8-10 near Woodington Rd.). Store them IN the high grassy area by Woodington Road where you will find other trailers; place them there by hand, not motorized vehicle. Do not leave them in front of the grasses but place them within the high grasses OR at the marina where you launched your boat.
* Glass, including drinking vessels and bottles, is not permitted in any common area.
* Soap or detergents shall not be used in the lake for any purpose whatsoever.
* All garbage is to be placed in standard green garbage bags and deposited in the tidy bins located at the entrance of teh driveway. No garbage shall be left outside the chalet. Dispose of garbage properly using the Blue Box for glass and tin and the green bags for other. No more than 3 bags per Wednesday, early morning pickup. Compressing the disposed containers (eg. cans; milk and egg cartons) does help.
* All water sports (skiing) are prohibited in the dock/swimming area for the safety of swimmers.
* Place all waterfront furniture in the manner in which it was found. Our owners are trying to instill a pleasant look on the property; our investment and perception by others is important to us.
* Do not dig trenches at the waterfront; erosion has hurt our beachfront.
* Ensure that the fire pit is fire and smoulder free after use. Do not use beach sand to put the embers out; use water.
*Please remove beach toys or sandbox toys after use. Ensure that all is "stored" properly to avoid a cluttered look. Floating toys/tubes/skiis should be stored in the appropriate owner's/renters's boat or cottage. Maintain a clean appearance at the cottage as well by keeping it clutter free as we do.
* No feeding of the wildlife. Bread to the ducks for example, upsets their normal wildlife behaviour and nutrtional base, especially for their young. If feeding chipmunks, only use natural foods that are typical of their nutritional base and do NOT feed them much over time. They become dependent and this can harm their survival modes of fending for themselves. They also become comfortable in the "open" and suseptible to predators when humans don't show up to feed them. Generally - enjoy, but do not feed.
* Please assist us by watering our outdoor and indoor potted plants.
* Please be fair to us and others by leaving at the appropriate time (10 am - Saturday) to allow us to clean up and by arriving no earlier than the appropriate time (2 pm - Saturday) to allow us to finish cleaning up.
* Members of Cedar Rail all have a "neighbourhood watch" agreement and may advise renters/guests of our guidelines as deemed appropriate as well as advise owners of renter/guest infractions, again as deemed appropriate. Two members of the executive are Alex Brooks and George McEachern, owners of units on the other side of the property.
We, the owners, may still be up for a day using the property/beach/boat while you are renting. We may come by for a "hello" but will not infringe upon your use, privacy and time while on your vacation.
